Tom McClintock: Congress should not seize the power to determine the presidential election



Representative Tom McClintock (R-CA) told Joel Pollack, host of SiriusXM's Breitbart News on Sunday, that Congress does not have the constitutional authority to reject the electoral vote count.


"Congress does not have the constitutional right to refuse to count the votes of states that it believes have acted fraudulently or unlawfully," said McClintock. He added that such a step amounts to an unconstitutional seizure of power by Congress and outside the states.


"This is a very dangerous force, and again, it completely undermines the entire concept of the Electoral College," said McClintock. "If Congress can decide itself, then what is the purpose of the Electoral College?"


McClintock commented, "I think the courts have failed us. I think the review process disappointed us greatly, but that doesn't give Congress the power to replace the legitimate role of the judiciary with its own ruling."
